Advertising Package Holidays and Time-Sharing in EC Law

Along with Food and Drug, the Travel and Tourism Markets are those with the most asymmetrical distribution of information. From the assumption that all Markets are legally built information systems, this information gap needs has to be solved though Regulation.

 

The same happened with the EC Travel and Tourism Markets: with Directives Council Directive 90/314/EEC and 94/47/EC the EC Law concerning Packaged Holydays and Time-Sharing imposes clear information duties to the Professional of theTrade and takes contractual consequences from them, or from the omission of them.

 

Even now, both Directives go well beyond the new Directive 2005/29/EC on Unfair Commercial Practices.
