USA: House approves European Union Emissions Trading Scheme Prohibition Act

On October 24, 2011, the United States House of Representatives approved H.R. 2594, the “European Union Emissions Trading Scheme Prohibition Act”. If passed by the Senate and signed by the President, the bill would force the Department of Transportation to bar U.S. airline operators from complying with the European Union’s Emissions Trading Scheme (ETS). The approval of the bill comes only three weeks after the Advocate General of the Court of the European Union (ECJ) had delivered her opinion stating that consideration of the questions referred had disclosed no factor of such a kind as to preclude the validity of the EU Emissions Trading Scheme Directive (2003/87/EC) as amended by the EU Aviation Emissions Trading Scheme Directive (2008/101/EC).The text of the bill can be found here>>.
