Schengen Borders Code precludes Germany from requiring coach companies to check passports

Under German law, any coach transport operator providing a regular cross-border service within the Schengen area to Germany must check the passports and residence permits of the passengers before they cross the German border in order to prevent a transport of third-country nationals not in possession of those travel documents to German territory.

U.S.A.: DOT fines airlines for not adequately responding to complaints of disabled passengers

The U.S. Department of Transportation (DOT) today fined Air France, Lufthansa, and British Airways for not adequately responding to complaints filed by passengers with disabilities.  Air France and Lufthansa were each fined USD 200,000 and British Airways was fined USD 150,000.  The airlines were also ordered to cease and desist from future similar violations.

Singapore: new regulation on tourist guides

According to the Singapore Tourism Board Act which came into force Oct. 7, 2014, tourist guides have to be licenced by the Singapore Tourism Board. Licenced tourist guides receive a tourist guide badge. Actiing as a tourist guide without a valid  licence is regarded an offence with a penalty of up to S$5,000 for the first offence and and upt to S$10,000 for the second or any subsequent offence. Any use of the services of an unlicensed guide is also regarded an offence with the same fines.

CJEU: passport cancelled - visa lives on

On 8 October 2010, an Indian citizen travelled from Moscow to Riga with Air Baltic. At the border control at Riga airport, he presented a valid Indian passport without a visa and a cancelled Indian passport to which a valid uniform visa issued by Italy was affixed. The Indian citizen was refused entry into Latvia on the ground that he did not have a valid visa. Moreover, the Latvian authorities imposed a fine of LVL 2 000 (approximately €2 850) on Air Baltic for transporting to Latvia a person without the travel documents necessary to cross the border.

USA: DOT fines Qantas for not informing passengers of opportunity to leave delayed aircraft

The U.S. Department of Transportation (DOT) announced that Qantas Airways violated federal rules last March by not informing passengers on a delayed aircraft at Dallas/Fort Worth International Airport that they had the opportunity to leave the plane as it sat at the gate for an extended period of time with the door open.  DOT fined Qantas USD 90,000 and ordered the airline to cease and desist from further violations.

USA: DOT fines United Airlines USD 1.1 million for lengthy tarmac delays

The U. S. Department of Transportation (DOT) on Oct. 25, 2013, fined United Airlines USD 1.1 million for lengthy tarmac delays that took place at Chicago-O’Hare International Airport on July 13, 2012.   The airline was ordered to cease and desist from future violations of the tarmac-delay rule. This is the largest fine assessed for a tarmac-delay violation since the rule limiting long tarmac delays first took effect in April 2010.

France: Court of Appeal affirms fine for price fixing in the leisure and tourism sector

In a decision of June 6, 2013, the Paris Court of Appeal upheld a decision of the French Competition Authority fining the Géfil trade association and ten consulting firms in the leisure, culture and tourism engineering sector a total amount of EUR 660.700 for having issued instructions to use “fair prices” and to avoid “dumping” and “price wars”. These instructions were found to have been used as a benchmark for price quotations filed by consulting firms in response to calls for tenders.

USA: DOT fines Virgin America for failing to make safety videos accessible to passengers with hearing impairments

The U.S. Department of Transportation (DOT) fined Virgin America USD 150,000 for failing to make its in-flight safety video accessible to passengers with hearing impairments.  The airline also was ordered to cease and desist from further violations.

USA: DOT fines Delta for violating Denied Boarding Rules

The U.S. Department of Transportation (DOT) assessed a civil penalty against Delta Air Lines for violating federal rules protecting passengers who are denied boarding against their will, or “bumped,” on oversold flights.  DOT fined Delta USD 750,000 and ordered the airline to cease and desist from further violations.

USA: DOT collected USD 3.6 M in fines for air passenger rule violations in 2012

The U.S. Department of Transportation (DOT) said it levied USD 3.6 million in penalties for 2012 violations of the department’s consumer-protection rules for air passengers. The total is up from USD 3.3 million in 2011. During 2012, the Department issued 49 consent orders for consumer rule violations, the most recent two against Copa Airlines and Virgin America for not strictly adhering to the DOT’s rules for lengthy tarmac delays.
