German court: lessor of holiday apartment must include costs of final cleaning into the advertised price

The defendant advertised holiday homes at Germany's Baltic coast in the internet where he indicated prices per week. However, only at the very end of the advertisment additional costs of a "final cleaning" were mentioned. The court (Schleswig-Holsteinsches OLG) held that the advertisment was contrary to German pricing law which requires the indication of the final price including all costs, fees and taxes.

Austria: tour operator not allowed to use consumers' pictures for travel brochures

The plaintiffs, a married couple, took part in a package trip to Scotland organised by the defendant. At the occasion of a visit to the old blacksmith's shop at Gretna Green, a pretended wedding cermony was enacted in which the plaintiffs played the bride and the groom. The bus driver took pictures of this 'ceremony'.

Canada: new Air Price Advertising Rules

In December 2011, the Government of Canada announced that the Canadian Transportation Agency would develop regulations requiring all-inclusive air price advertising. These regulations are now published on Part II of the Canada Gazette.

USA: airlines to challenge DOT advertising rule before U. S. Supreme Court

Three airlines have challenged the Transportation Department’s new price-advertising rule nefore the U.S. Supreme Court, claiming that the DOT is violating the First Amendment by prohibiting airlines from advertising base prices net of taxes and fees. The airlines also claim that the DOT has been violating the Airline Deregulation Act by imposing unique requirements such as “the size of typeface and the length of mandatory refunds — in an industry that Congress expressly chose to deregulate.”

USA: Federal Trade Commission requires hotels to disclose all mandatory surcharges

The Federal Trade Commission (FTC) has warned 22 hotel operators that their online reservation sites may violate the law by providing a deceptively low estimate of what consumers can expect to pay for their hotel rooms. According to the FTC letters, one common complaint consumers raised involved mandatory fees hotels charge for amenities such as newspapers, use of onsite exercise or pool facilities, or internet access, sometimes referred to as ‘resort fees'.

Austria: tricky copyright traps in hotel advertising

The plaintiff, a painter, had made a sales exhibition of her paintings in the premises of the defendant hotel company. After the exhibition, the paintings (none of which had been sold) remained in the hotel for some time for a monthly fee to be paid by the defendant. During the exhibition, pictures of the hotel were taken which the defendant then used on its website. On one of these pictures, the plaintiff's painting "Mozart Symponie No 41" could be seen hanging on a wall in the background.

"Reviews you can trust" - UK Advertising Standards Authority finds TripAdvisor ads misleading

Claims on tripadvisor.co.uk, a website providing holiday and travel consumer reviews, stated "... read reviews from real travellers ... TripAdvisor is the world's largest travel site, enabling travellers to plan and have the perfect trip. TripAdvisor offers trusted advice from real travellers and a wide variety of travel choices and planning features ... TripAdvisor.com features: More than 50 million honest travel reviews and opinions from real travellers around the world".

USA: DOT fines Spirit Airlines over handling of disability complaints and Finnair for violating price advertising rules

The U.S. Department of Transportation (DOT) fined Spirit Airlines USD 100,000 for failing to appropriately record and respond to complaints about the carrier’s treatment of passengers with disabilities, violating DOT’s rules implementing the Air Carrier Access Act which prohibits discrimination in air travel on the basis of disability.
